1. Acceptance of Terms
By accessing or using the Stalletjie platform ("Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. Stalletjie is operated from South Africa and these terms are governed by South African law.
2. Description of Service
Stalletjie is a two-sided online marketplace that connects stallholders (vendors who trade at markets, festivals and pop-up events) with event organisers across South Africa. We provide the platform; we are not a party to any agreement between stallholders and organisers, do not arrange the event itself, and do not handle stall fees, deposits or on-site logistics.
3. User Accounts
You must create an account to list a stall, post an event, apply to events or contact other users. You are responsible for keeping your login details confidential and for everything that happens under your account. You must provide accurate, complete and current information.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in breach of South African law
- Misrepresent yourself, your products, your stall, or an event
- Post offensive, discriminatory, misleading or infringing content
- Harvest contact details for spam, bulk messaging or unsolicited marketing
- Attempt to bypass, scrape, reverse-engineer or disrupt the Service
- Use automated systems to access the Service without our written permission
5. Stallholder Responsibilities
Stallholders are solely responsible for:
- Holding the correct trading permits, food-handling certificates, liquor licences and any other permissions required by law
- Carrying any insurance (public liability, product liability, stock) appropriate to your trade
- Accurately describing your products, prices, allergens and origin
- Honouring any booking you accept from an organiser, including arriving on time and trading for the agreed hours
- Paying any stall fees, deposits or commissions agreed directly with the organiser
6. Organiser Responsibilities
Event organisers are solely responsible for:
- Holding the correct event permits, venue agreements, health & safety approvals and council permissions
- Honestly representing the event (date, venue, expected foot traffic, target audience, stall fees and inclusions)
- Final selection of stallholders, allocation of spaces and on-site management
- Refunding stall fees in line with their own published cancellation policy when an event is cancelled or materially changed
7. Subscriptions & Fees
Stalletjie is currently free for event organisers. Stallholders pay a recurring subscription of R199 per year to access the matching, application and contact features. Subscriptions are billed in South African Rand via Paystack and renew automatically until cancelled. See our Refund Policy for cancellation and refund terms.
Stalletjie does not collect stall fees, deposits or commission on bookings made between stallholders and organisers. Those are arranged and paid directly between the parties.
8. Content & Intellectual Property
The Service and its original content, branding and software are owned by Stalletjie and protected by South African and international copyright, trademark and other intellectual property laws. You keep ownership of the photos, descriptions and other content you upload, but grant us a worldwide, royalty-free licence to host, display, resize, distribute and promote it for the purpose of operating, marketing and improving the Service.
9. Listings & Moderation
We may review, edit, decline, suspend or remove any listing, application, message or account at our reasonable discretion — including listings that are inaccurate, misleading, unlawful, off-brand, or that breach these Terms. We are not obligated to monitor every listing, but we will act on reports of abuse.
10. No Endorsement, No Guarantees
Stalletjie does not vet or endorse any individual stallholder, organiser or event. We do not guarantee bookings, attendance, sales, foot traffic, weather or that any user will perform their obligations. Any decision to apply to, accept or attend an event is made at your own risk.
11. Limitation of Liability
To the maximum extent permitted by South African law, Stalletjie shall not be liable for any indirect, incidental, special, consequential or punitive damages — including lost profits, lost sales, spoiled stock, travel costs, cancelled events or disputes between users — arising out of or in connection with your use of the Service. Where liability cannot be excluded, our total liability is capped at the fees you have paid us in the 12 months before the claim.
12. Termination
You may close your account at any time from your dashboard or by emailing us. We may suspend or terminate accounts that breach these Terms, that are inactive for an extended period, or where required by law. Paid subscriptions that are terminated for cause are not refundable beyond the terms of our Refund Policy.
13. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes by email or in-app notice and update the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Disputes are subject to the non-exclusive jurisdiction of the courts of South Africa.
Consumers in the EU, UK or other jurisdictions: nothing in these Terms removes or limits any mandatory statutory rights you have under your local law, including your right to bring proceedings in the courts of your country of residence.
